Se declaró la nulidad de todo lo actuado en la acción de tutela promovida a través de apoderado contra la Dirección de Impuestos y Aduanas Nacionales, a partir del auto proferido por el Juzgado Tercero Penal Municipal de Santa Marta, toda vez que aplicó lo dispuesto en el Art. 1 del Decreto 1382 de 12 de junio de 2000 que, como ya se dijo, resulta contrario a la Carta Política.
En consecuencia, se remitió el expediente al mencionado Juzgado para que realice el trámite que corresponda conforme a la Ley.

- Primero. DECLARAR la nulidad de todo lo actuado en la accion de tutela promovida a traves de apoderado, por la senora Betsy Rosa Nunez de Saravia contra la Direccion de Impuestos y Aduanas Nacionales, a partir del auto de diez y seis (16) de agosto de 2000 proferido por el Juzgado
- Tercero. Penal Municipal de Santa Marta, visible a folio 34 del expediente.
- Segundo. REMITASE el expediente por Secretaria al Juzgado
- Tercero. Penal del Circuito de Santa Marta, para que, de manera inmediata se le imprima e esta accion de tutela el tramite que corresponda conforme a la Ley.
